Starry Fae Studios Terms of Service

These terms apply to orders and commissions from Starry Fae Studios / Starry Fae Apollo. 

By placing an order and agreeing to these terms, you accept the rules below. The rules of Etsy, Ko-fi, or another payment platform also apply. If the law or platform gives you more rights, those rights still apply. 

1. Payment and Orders 

  • Full payment is required before I begin work or ship an item. 
  • An order is not confirmed until payment is received. 
  • Prices are shown in the currency listed on the item page or invoice. 
  • The buyer is responsible for any taxes, customs charges, or import fees required in their country. 

2. Custom Work and Art Commissions

Timing and Delivery 

  • Most commissions take 1 to 4 weeks. 
  • This is an estimate unless we agree to a firm deadline in writing. 
  • The timeline may change because of my queue, the size of the project, illness, emergencies, or slow replies. 
  • Final files will be sent through the agreed platform, email, or download link.

Communication 

  • Please reply when I ask for feedback, approval, or missing details. 
  • If I do not hear from you for 7 days, I may continue using my best judgment or deliver the work in its current finished state. 
  • If I do not hear from you for 30 days, I may close the commission as abandoned.
  • Work already completed is not refundable if a commission is abandoned. 

Revisions 

  • Two free revision rounds are included during the sketch/prototype sculpting stage. 
  • Major changes should be requested before the
    sketch/prototype approval. 
  • Extra revisions, or changes requested after sketch/prototype approval, cost $15 each.
  • I will fix my own mistakes, such as a missing agreed detail, for free. 
  • A large change to the character, pose, design, or original request may require a new commission and payment. 

Cancellations and Refunds 

  • You may cancel for a full refund before I begin work. 
  • After work begins, any refund will be based on the unfinished part of the commission.
  • Completed work is not refundable for a change of mind, except as required by law or the payment platform.
  • If I cancel, I will refund any work I did not complete. 

3. Physical Items and Shipping 

Returns and Refunds for Physical Items


Custom and personalized items usually cannot be returned for a change of mind. Returns for other items follow the policy written hereafter. Any extra rights provided by local consumer law still apply.

For returns:

  • Please check your shipping address before ordering. 
  • If an order is returned because the address was wrong or incomplete, you may need to pay to ship it again. 
  • Contact me within 14 days of receiving the item.
  • Return the item in its original condition.
  • The buyer is responsible for return shipping unless the item arrived damaged, defective, or incorrect due to an error on my part.
  • A refund will be issued after I receive the returned item or as otherwise required by applicable law.

4. Artwork Rights and Personal Use 

I keep the copyright to artwork I create. Buying an item or commission gives you permission to use that specific work under these terms. It does not transfer the copyright to you. 

For personal-use artwork, you may: 

  • Use and display it for personal purposes. 
  • Post it online with visible credit to @StarryFaeApollo or Starry Fae Studios.

Without written permission, you may not: 

  • Claim that you made the artwork. 
  • Remove my signature or watermark. 
  • Edit, trace, recolor, or make major changes to it. 
  • Resell, copy, share, or redistribute the full-resolution file. 
  • Use it for a business, advertisement, paid product, or other commercial purpose.
  • Use it in monetized streams, videos, or channel branding. 
  • Use it for AI training, machine learning, NFTs, blockchain projects, or tokenized media.
  • Use it in an illegal or defamatory way. 
  • I may show commissioned artwork in my portfolio, shop, or social pages unless we agree in writing to keep it private. 

5. Commercial Artwork Licenses 

Commercial use is not included with a normal personal-use purchase. 

Streaming and Content Creator License: $25 per image 

This allows one creator or channel to use the image for monetized streams, videos, channel branding, overlays, or creator promotion. 

It does not include merchandise. 


Merchandise License: Starts at $1000 per image

This allows the image to be used on physical or digital products made for sale, including merchandise and print-on-demand products.

Unless we agree otherwise in writing: 

  • A license covers only the named image and one creator or business.
  • The license is not exclusive. 
  • I keep the copyright and may still show the work in my portfolio. 
  • Commercial rights begin after the license is paid in full. 

6. 3D Prints and Model Files 

The item page or invoice will say which license applies. 

Physical Print Commercial Use 

This label is often used for costume pieces, props, and wearable parts.

  • You may use the physical print in paid costume work, performances, commissions, or monetized content. 
  • You may sell a finished costume or prop that includes the print. 
  • This permission covers the physical item only. 
  • It does not include the digital model file.
  • Purchasing a physical print does not transfer ownership of the design, model, or intellectual property behind the item.

Personal Use Only 

This label is often used for figurines, collectibles, and display models. 

  • You may use the item for personal, non-commercial purposes. 
  • You may not reproduce the item, make molds, casts, or scans of it, or manufacture copies or derivative products for sale.

Commercial License Required 

Ask for written permission and pricing before using an item or design with this label for business purposes. 

Digital Model Files 

All digital model files follow these rules: 

  • Do not share, resell, upload, sublicense, or redistribute the file. 
  • Do not upload it to a marketplace, repository, or file-sharing site. 
  • Editing the file does not give you ownership or new rights. 
  • Copyright stays with me or the original rights holder. 
  • If no license label is shown, the item is Personal Use Only. 

7. Product Safety and Age Limits 

All physical products are designed for their intended purpose only.

  • Articulated critters, collectibles, costume accessories, fursuit parts, props, and other 3D printed items are intended for ages 14 and older.
  • Choking hazard: Articulated critters and other products may contain small parts. Parts may also break off if the item is damaged or handled roughly. Keep all products away from babies, young children, and pets. Do not place any part in the mouth.
  • Costume accessories, fursuit piercings, ear tunnels, props, and wearable pieces are not made for human body piercing or medical use. Do not place them inside the mouth, eyes, wounds, or human piercings.
  • Stop using an item if it becomes broken, sharp, loose, uncomfortable, or unsafe.
  • I am not responsible for injury or damage caused by misuse, unsafe handling, improper installation, modification, rough handling, failure to follow product instructions, or using an item for something it was not designed to do.
  • To the extent permitted by law, this section does not limit any rights or responsibilities that cannot legally be limited.

8. Refusal of Service and Payment Problems

I may refuse or cancel an order because of: 

  • Harassment or abusive behavior. 
  • Fraud, scams, or payment problems. 
  • A request that breaks these terms. 
  • A request outside my skills or comfort level. 
  • If I cancel, I will refund anything that was not delivered. 

Please contact me first if there is a problem so I have a chance to fix it. You still have the right to use a payment provider’s dispute process when allowed by law. 

If a payment is fully refunded, you must stop using the artwork or files tied to that payment unless we agree otherwise in writing. 

Serious fraud, harassment, or art theft may be reported to the platform, payment provider, or proper authorities. 

9. Privacy and Order Information 

Payments and orders are handled through third-party platforms such as Etsy,
Big Cartel, and Ko-fi. Their privacy policies cover the information they collect and store. 


I may use information available to me, such as your email address, order details, messages, and transaction records, only to:

  • Complete and deliver your order.
  • Contact you about your order.
  • Keep required business and tax records.
  • Handle refunds, disputes, or legal issues.
  • Use third-party platform features for store updates, order notifications, or customer communications.


I do not receive or store payment card information. I do not sell customer information.

You may ask me to delete information I personally keep. I will delete it when reasonably possible, except when I need to keep it for taxes, accounting, disputes, platform rules, or other legal reasons. 

10. Legal Basics 

I am not responsible for delays caused by events I cannot reasonably control, such as illness, emergencies, natural disasters, outages, supply problems, or postal delays. 

As far as the law allows, I am not responsible for indirect losses caused by an order or delay. Nothing in these terms removes rights or responsibilities that cannot legally be removed. 

These terms follow the laws of ILLINOIS, United States. Mandatory consumer laws in the buyer’s location still apply when required. 

11. Agreement 

By placing an order, checking an agreement box, or confirming in writing that you agree, you confirm that you have read and accepted these terms.
